We kindly ask you to carefully read this Privacy Policy to understand how your personal data is collected, processed and stored when you use the mobile application or the « DUODECI » website (hereinafter indifferently, « DUODECI » ).

Under this Privacy Policy, the controller of the collection of personal data is: OPUSGEM (hereinafter the « Company », « we », « us » and « our »), a simplified joint-stock company with variable capital of 125,000 euros, registered in the Register of Commerce and Companies of Bourges (France) under number 812 964 021, whose head office is located at Domaine des Colas 18210 Saint-Pierre les Etieux (France).

1. When can we collect personal data about you?

We receive and process a certain amount of information, which may include personal data about you when you access and use DUODECI, especially when:

  • you complete any information form about DUODECI, especially during your registration or when you update the information of your user account
  • during your navigation on DUODECI.
2. What information and personal data do we collect?

a- User account credentials and supporting documents to join a DUODECI community.

When you register on DUODECI, you will be asked to enter a certain amount of personal data needed to create your user account. It is mainly data to identify you such as your name, surname and email. When you apply for membership in a specific community on DUODECI, we can also collect supporting documents on your professional situation to verify that your profile is in line with the chosen community.

b- User profile data

Following the creation of your user account, you have the option of completing your profile in order to introduce yourself in more details to the other members of DUODECI.

In this respect, we will collect all the personal data that you decide to publish on your profile including your photograph and additional information about your professional and / or personal life.

c- Navigation and connection data

When you use DUODECI, we may also collect connection data, that is to say information that is automatically recorded by our servers when you access DUODECI or when you use it, whether you are registered on DUODECI or not and whether you are connected to your user account or not.

This connection data may include the following non-exhaustive list of elements: your IP address, the date and time you access or use DUODECI, the type of operating system, the connection type, the version number of the installed Application, the type of mobile equipment.

We may also collect different types of information relating to your use of DUODECI, such as the pages viewed and the order of consultation. This login information may be collected via cookies and other similar technologies, such as mobile application identifiers, on DUODECI. As detailed below in our policy on cookies, cookies are small files that are stored on the computer of visitors and users primarily to facilitate the navigation and use of DUODECI.

3. Why do we collect personal data and on what legal basis?

We collect, process and store your personal data for the following purposes:

  • When you use DUODECI and create a user account and / or ask to join a community and / or complete your user profile, your personal data will be processed and stored to allow the creation of your user account and for the purposes of proper administration of the services offered, including linking, and other features of DUODECI, in accordance with the commitments we made on DUODECI and in our global terms and conditions of use and sale. This processing of your personal data exists for the purpose of allowing us to meet our contractual commitments.
  • When you agree to receive commercial offers from DUODECI or our commercial partners during your registration, your personal identification data will be used for the purpose of directly sending you commercial solicitations. This processing of your personal data can only take place if you gave consent for it.
  • As part of the proper administration of our services, we may also collect your personal data in order to send you messages concerning your use of DUODECI, assistance and administrative messages, reminders, technical notifications, updates, security alerts, in accordance with the commitments of our global terms and conditions of use. 4- In which situations can we disclose or share your personal data and with whom?

We may share your personal data in the following situations:

  • Your personal data may be transmitted to technical partners, including our host, our payment provider, our provider of time stamping and our provider of electronic signature. These providers allow us to provide all of our services on DUODECI in accordance with the contractual conditions signed between these partners and the Company, which cannot deviate from the terms of this privacy policy.
  • Provided that you gave consent during your registration, your personal data may be shared with our business partners so that they may send you messages with privileged offers and commercial solicitations.
  • Your personal data may be communicated to the police services (if required by law) or to any person legally authorized to receive this information (by order of the judge).
  • Eventually, if the Company undertakes or is involved in a merger, acquisition, restructuring, asset transfer or bankruptcy or insolvency proceeding, it may sell, transfer or share all or part of its assets, including your personal data. In this case, we will inform you before your personal data are transferred and governed by another personal data protection charter.
5- What are the security and hosting measures associated with the preservation of your personal data? We take care to secure the personal data of the users appropriately and have taken the necessary precautions to preserve and to make sure that our host also preserves the security and confidentiality of the data and in particular to prevent them from being distorted, damaged or communicated to unauthorized persons.

All the personal data we collect is hosted in France and Europe. We do not transfer personal data to third parties established outside the European Union and that do not offer an adequate level of protection with regard to the legal requirements for the protection of personal data.

Any personal data will be destroyed immediately after the deletion of your user account on DUODECI or after the withdrawal of your consent for data that were subject to your consent.

However, we will be able to keep the data related to the execution of your contract in separate archives so as to be able to defend our rights in court within a period not exceeding the applicable limitation period, namely five years from the end of the contract.

7- How to exercise your rights

In accordance with the European regulations on the protection of personal data, you have the following rights:
  • A right of access allowing you at any time to know if your personal data are or are not processed by our services and when they are, to have access to the said personal data and to information on the conditions under which the processing of this data occurs as specified by the law
  • A right of rectification allowing you to ask that is corrected as soon as possible any inaccuracy concerning the personal data concerning you
  • A right to erasure, allowing you to request as soon as possible that your personal data are erased when (i) their preservation is no longer necessary for the purposes for which they were collected (ii) you are opposed to treatment and therefore wish it to be erased; (iii) the data has been unlawfully processed; (iv) the data must be erased to comply with a legal obligation that is provided for either by the law of the European Union or by French law
